Six Things Changing for "Security and Order" Businesses on November 15, 2026 (Decree 392/2026)

Six Things Changing for "Security and Order" Businesses on November 15, 2026 (Decree 392/2026/NĐ-CP) 🏨🎰🔥

📖 Word Nerd Corner: "Security" Means "Without Worry"

The word "security" comes from the Latin securus: se- ("without") + cura ("care, worry"). To be secure is, literally, to be free from worry. 😌 And "order" comes from ordo, meaning a "row" or "rank," a thing arranged in its proper place. So Vietnam's legal category of businesses subject to conditions on "security and order" (an ninh, trật tự) is, etymologically, about keeping things worry-free and in neat rows. Decree 392/2026/NĐ-CP, issued on October 20, 2026 and applying from November 15, 2026 (nine days from today, November 6), re-arranges a number of those rows. Let's walk through six changes. 🚶

🔗 Connection to my last post: if you read my post on DPIA and CbTIA filings, you've already met this number. The source for that post says Decree 392/2026/NĐ-CP, issued October 20 and effective November 15, 2026, also changes personal data impact assessment procedures. This post's source describes a decree with the same number, issue date, and effective date amending the security-and-order business rules (and it mentions personal data processing services among the many topics it touches). That suggests one omnibus decree amending several earlier decrees, but check the official text to confirm.
Two Quick Visuals 📊 🏨 Hotel check-in: 5 accepted ID types 1. Căn cước (identity card) ✅ new 2. Căn cước công dân (citizen ID card) 3. Passport 4. Permanent/temporary residence card (foreigners) 5. Other photo-bearing ID issued by a Vietnamese agency 🚫 Old ID card (chứng minh nhân dân) removed No ID? Room can still be given, but notify commune police or local police station immediately. 📋 Lines needing a security plan Before 13 After 10 Prize games, casinos, and betting are now grouped as one line.

1️⃣ 🏨 Five ID Types Accepted at Hotels and Guesthouses

Article 14 of Decree 392 amends Clause 2, Article 44 of Decree 96/2016/NĐ-CP on the responsibilities of lodging businesses. A lodging business may check one of five types of document:

  1. 🪪 Căn cước (identity card)
  2. 🪪 Căn cước công dân (citizen identity card)
  3. 📘 Passport
  4. 🛂 Permanent or temporary residence card for foreigners
  5. 📄 Other photo-bearing documents proving identity, issued by Vietnamese state management agencies

👤 Guests with no ID: They can still be given a room, but the establishment must notify the commune-level police or the police station managing the area immediately after assigning the room.

🔄 What changed from Decree 96/2016: Căn cước was added, the old ID card (chứng minh nhân dân) was removed, and the catch-all wording changed from documents "with an affixed photo" to documents "with identity-proving value" bearing a photo. The notice recipient is now specified as commune-level police or the local police station.

🛎️ Everyday picture: Receptionist Rina at the Moonlight Inn checks in Traveler Tom, who shows his passport. ✅ Then Guest Gia arrives, having left her ID at home. Rina can still give Gia a room, but right after doing so she must notify the commune police or the local police station. Rina's check-in procedure should say exactly who to call and how. 📞
🤔 Did you know? As far as I know (general background, not from the source), the old-style ID cards (chứng minh nhân dân) stopped being valid at the end of 2024 under the Law on Identity, which fits with them dropping off this list. Worth verifying if you handle guests with older documents. 🪪

2️⃣ 📚 The List of 15 Conditional Business Lines Gets Tidied

Article 1 of Decree 392 amends Article 3 of Decree 96/2016 to set out 15 groups of business lines subject to conditions on security and order, and the scope of each. Familiar groups include:

  • 🔏 Seal production
  • 🛡️ Support tools, including repair
  • 🎆 Fireworks, except explosive fireworks
  • 💍 Pawnshop services
  • 💆 Massage services
  • 🚨 Signal devices for priority-right vehicles
  • 👮 Security guard services
  • 🎲 Prize games
  • 🏨 Lodging services
  • 🎤 Karaoke and nightclubs
  • 💥 Industrial explosives, explosive precursors, and related lines...

The big change is structural. Rather than listing many separate items as before, the decree restructures, merges, and adjusts scope. Notably, electronic prize games for foreigners, casinos, and betting are now grouped under prize games, and some lines are renamed or re-scoped to fit current specialized laws.

3️⃣ 🎰 Casinos and Prize Game Venues Can Check Customers via VNeID

Article 13 of Decree 392 amends Clause 2, Article 33 of Decree 96/2016, on the responsibilities of prize game businesses (including electronic prize games for foreigners, casinos, and betting). In addition to the responsibilities in Article 25, they must:

Check personal information on the national identification app (VNeID) or the customer's ID documents, and record the full information in the management book.

So from November 15, 2026, these venues can use VNeID to verify customers instead of relying only on physical ID papers, and they must still record full customer information in the book.

Old rule (Decree 96/2016, Art. 33.2)New rule (Decree 392/2026, Art. 13)
Check the customer's ID, record full information in the management book, and keep a copy of the ID of customers using the serviceCheck personal information on VNeID or the customer's ID, and record full information in the management book
⚠️ Look closely at the last words: the new text as quoted in the source doesn't repeat the old duty to keep a copy of the customer's ID. The source doesn't comment on that, so don't assume the copy requirement has disappeared. Check the full amended Article 33 and the related Article 25 before changing your procedures. (The source's comparison cites "Decree 96/2026"; given the context, I've read that as a typo for Decree 96/2016.)
🎰 Everyday picture: At Lucky Star Resort Casino, a staff member could now verify a guest through VNeID rather than only examining a card, and then enter the guest's details in the management book.

4️⃣ 📋 Ten Business Lines Must Have a Security and Order Plan

Article 2 of Decree 392 amends Clause 1, Article 8 of Decree 96/2016. Ten lines now must have a plan to ensure security and order:

  1. Support tools, including repair
  2. Fireworks, except explosive fireworks
  3. Prize games, including electronic prize games for foreigners, casinos, and betting
  4. Industrial explosives
  5. Explosive precursors
  6. Lines using industrial explosives and explosive precursors
  7. Blasting services
  8. Nightclub services
  9. Lodging services, for businesses that are enterprises
  10. Handguns, shoulder-fired guns, and ammunition for those weapons, equipped for the armed forces and other forces as provided by law

The old Clause 1 of Article 8 covered 13 lines. That list had separate entries for electronic prize games for foreigners, casinos, and betting, and it also included paintball guns and small military handguns. The new list is 10.

💡 Two small observations: (1) Lodging only needs a plan when the business is an enterprise, which is a distinction worth noting if you run a small guesthouse. (2) Paintball guns appear in the old list but not in the new one, and I couldn't tell from the source what happens to that line. Check the decree text if it affects you.

5️⃣ 🔏 Seals, Military Gear, and Fireworks: Who May Do What

Article 3 of Decree 392 amends Article 13 of Decree 96/2016 on conditions for certain business lines:

  • 🏛️ Seals with the National Emblem or the Police badge: only establishments under the Ministry of Public Security may produce them, except establishments already operating before November 15, 2026.
  • 🪖 Seals with the Army insignia and seals under the Ministry of National Defense's management: only the professional management agency or an assigned unit under the Ministry of National Defense may produce them.
  • 🎖️ Military and police uniforms, equipment, military weapons, technical equipment, and specialized means: establishments outside the Army and Police may deal in them only when ordered, assigned, or selected through bidding by a competent Army or Police authority.
  • 🎆 Fireworks (except explosive fireworks): only establishments under the Ministry of National Defense and the Ministry of Public Security may trade in them.
⚠️ Transition note: the source mentions a grandfather exception for seal producers already operating before November 15, 2026, but it states no such exception for fireworks. Don't assume one exists; check the decree's transitional provisions.
🎆 Everyday picture: Sparkle Shop is a private store that sold non-explosive fireworks. Under the rule as the source describes it, only establishments under the two ministries may now trade in them. The shop owner should check the transitional rules right away.

6️⃣ 🔥 Fire Safety Paperwork Gets Redefined

Article 4 of Decree 392 amends Clause 3, Article 19 of Decree 96/2016 on the documents proving fire safety conditions.

  • 📄 Valid proof for the business area and for warehouses storing raw materials and goods: the fire prevention inspection record issued by the competent authority under the law on fire prevention, firefighting, and rescue.
  • 🚫 Not required to submit this document: seal production; security guard services; betting; and trading in certain devices for measuring speed, alcohol concentration, and drugs, as well as equipment for analyzing and scanning mobile information.
  • 🏭 No storage of your own? You need a warehouse lease contract for a warehouse that meets fire safety conditions.
  • 💥 Explosives lines: for lines using industrial explosives and explosive precursors, or blasting services, the fire safety proof is the documentation of the warehouse for storing the industrial explosives and precursors.

🧾 And There's More

The source adds that Decree 392 also amends many provisions on seal management, identity cards (căn cước), weapons, explosives, support tools, and personal data processing service businesses. It's a wide-ranging decree, so check the full text for your sector.

🌿 Nature's version: At a beehive entrance, guard bees check every arriving bee by scent. Nestmates are waved in, and strangers are examined before they get past the door. 🐝 When a bee arrives without its usual scent, the guards don't automatically attack. They assess, then decide. A hotel front desk checking ID and then notifying the police about a guest without documents is a human version of the same idea: check at the door, and escalate what you can't verify.

💡 Practical Tips

🏨 If you run a hotel or guesthouse

  • Update your check-in procedure by November 15: accept căn cước, and stop treating the old ID card as an accepted document.
  • Write a "no ID" script: assign the room if appropriate, then notify the commune police or the local police station immediately. Put the contact details at the front desk.
  • If you are an enterprise, check whether you need a security and order plan.

🎰 If you run a prize game venue

  • Decide how VNeID checks fit your process, and keep recording customer information in the management book.
  • Confirm the copy-retention rule before changing anything.

🏢 If you're in any of the 15 lines

  • Map your business to the new grouping. Merged and renamed lines can change which rules you fall under.
  • Check your fire safety documents against Article 4 and see whether your line is exempt from submitting them.
  • If you make seals or trade in uniforms, military gear, or fireworks, review who is now allowed to do what, and look at the transition rules.
