Power of Attorney vs Property Witnessing: What Lawyers Can (and Cannot) Do! ⚖️


Etymology: 

"Attorney" comes from Old French "atorné" - one appointed. But who can appoint whom? Let's dive in!

🚫 What Lawyers CANNOT Do:

  • Witness property transactions
  • "Certify" real estate deals
  • Replace notary services

What Lawyers CAN Do (New MOJ Guidance) ✅

For Client Representation:

  • Use Legal Service Contracts
  • Have Powers of Attorney
  • Sub-authorize staff

The Core Issue ⚖️

Law firms typically use 3 documents with clients:

  1. Legal Service Contract
  2. Lawyer Request Letter
  3. Power of Attorney (POA)

The Problem 🤔

  • Since late 2023, notary offices started refusing POAs
  • They claimed lawyers can only use service contracts
  • This caused major headaches for law firms

Why This Matters 📋

Current Workarounds (All Problematic):

  1. Individual POAs
    • Need new POA for each staff member
    • Clients must sign multiple times
    • Very inefficient! 😫
  2. Single Lawyer POA
    • One lawyer gets authorization
    • Must notarize sub-authorizations
    • Agencies demand "red stamps" 🔴
  3. Contract-Only Approach
    • Some rely on service contract alone
    • Many agencies reject this
    • Creates practical problems

MOJ's New Position 🌟

The Ministry says:

  • POAs ARE allowed with service contracts
  • Not prohibited by law
  • Must align with contract scope

What This Means 💡

Law firms can now:

  • Continue using POAs
  • Base them on service contracts
  • Include sub-authorization rights

But Wait... ⚠️

Until official written guidance comes:

  • Local notaries may still refuse
  • Implementation remains challenging
  • Each locality may differ

  • NOT = Certifying property transactions
