The Great Training Escape: When Companies Sue Ex-Employees for Training Costs 🎓💸

The word "training" comes from the Old French trainer, meaning "to drag or draw along". Ironically, in today's case, it's the employee trying to drag themselves OUT while the company tries to draw them back IN... to court! 💼⚖️



In a Nutshell 🥜

Imagine training a dolphin 🐬 to perform amazing tricks, only to have it swim away to another aquarium! That's essentially what happened when UniTech Vietnam invested heavily in training their engineer Henry Hoang, who then jumped ship faster than you can say "resignation letter"!

Today's legal adventure takes us to Hai Phong, where a company learned that demanding 100% training cost reimbursement might be as unrealistic as expecting your cat to pay rent! 🐱💰

On September 21, 2020, Henry Hoang joined UniTech Vietnam as a Senior Engineer Level 6, earning a sweet 25 million VND/month. The company saw potential and decided to invest in him like a prized racehorse! 🏇

The Deal:

  • 🎓 6-month training in Shanghai
  • 💼 2-year commitment post-training
  • 📜 Training agreement signed October 3, 2020

Act 2: Shanghai Nights & Working Days 🌃

From October 2020 to April 2021, Henry was shipped off to Shanghai for "training." But plot twist! 🎭 Henry claimed he was just working normally, not receiving any special training!

Company's Version: "We taught him our secret sauce!" 🥫 Henry's Version: "I was just doing regular work!" 💻

The company spent:

  • ✈️ Flight tickets: 2,196,500 VND
  • 🛡️ Insurance: 2,649,950 VND
  • 📋 Visa fees: 685,000 VND
  • 💰 Training allowances: 27,465,000 VND
  • 🏥 COVID quarantine: 4,109,400 VND

Act 3: The Great Escape 🏃‍♂️💨

On March 5, 2022, after serving just 364 days of his 2-year commitment, Henry submitted his resignation. He gave less than 30 days' notice (only 28 days!) and peaced out! ✌️

Henry's excuse: "Personal reasons" 🤷‍♂️ Company's reaction: "OH HELL NO!" 😤

The Hai An District Court had to answer:

  1. Was the training real or just regular work? 🤔
  2. Should Henry pay back 100% or proportionally? 💭
  3. Was the resignation legal? 📝

The court ruled with Solomonic wisdom:

Training was REAL - Documents proved it! ✅ Henry violated the 30-day notice rule - Only gave 28 days! ✅ BUT - Proportional payment only! Not 100%!

Final damages:

  • 🗓️ Half-month salary penalty: 12,500,000 VND
  • 📚 Training costs (proportional): 25,657,347 VND
  • Total: 38,157,347 VND
