Face Off: The Plastic Surgery Predicament in Vietnam 🇻🇳💉

Etymology  Corner 🔍

"Biometrics" comes from the Greek words "bio" (life) and "metron" (measure). It's like Mother Nature's way of saying, "You're unique, baby!" 👶

Hey there, beautiful people! 👋 Today, we're diving into the wild world of plastic surgery and its unexpected legal consequences in Vietnam. It's like a game of "Guess Who?" but with your government ID! Let's break it down, Ngọc Prinny style. 🕵️‍♀️🔍

The Beauty Bombshell 💣

As of July 1, 2024, Vietnam dropped a beauty bombshell: biometric authentication for online bank transactions over 10 million VND (about $391). That's right, folks – your face is now your financial friend! 👍👀

But what happens when your face doesn't match your ID? It's like showing up to a party in a costume, but the bouncer has your high school yearbook photo! 🎭🚫

The Plastic Surgery Predicament 🤔

Here's where it gets tricky. If you've had a nip here, a tuck there, or a complete facial overhaul, you might find yourself in a bit of a pickle. 🥒 Your new look might be Instagram-worthy, but if it doesn't match your citizen ID card, you're in for a bureaucratic adventure!

As you can see, the more dramatic the change, the more likely you'll need to update your documents! 📊

Real-Life Examples 🏠🚗

Imagine you're Kim, fresh from a dramatic nose job and eye lift. You're feeling fabulous, but when you try to make a bank transfer, the system goes "Who are you?!" 🤷‍♀️ It's like your money is playing hard to get!

Or picture this: Minh has just had his jawline chiseled to perfection. He's ready for his vacation abroad, but at the airport, the immigration officer looks at his passport photo, then at him, then back at the photo. It's like a game of "Spot the Difference" that no one wants to play! ✈️🕵️‍♂️

Did You Know? 🤔🤔

  • Vietnam is one of the first Southeast Asian countries to implement nationwide biometric authentication for banking! 🥇
  • The biometric data is stored in the national population database. It's like a digital beauty pageant where everyone's a contestant! 👑
  • You might need to update your ID card, passport, AND driver's license after significant plastic surgery. It's like a government-issued makeover kit! 💄🪞

Quick Quiz 📝

  1. After plastic surgery, which document do you ALWAYS need to update? a) Library card b) Gym membership c) Citizen ID card
  2. True or False: Minor cosmetic procedures always require ID updates.
  3. What's the minimum transaction amount requiring biometric authentication? a) 5 million VND b) 10 million VND c) 20 million VND

(Answers at the bottom of the post!)

Tips for Navigating the Beauty Bureaucracy 💡

  1. Plan Ahead: If you're considering major plastic surgery, factor in time for document updates. Beauty is pain, and apparently, paperwork too! 📋✨
  2. Keep Records: Hang onto before and after photos. They're not just for your Instagram – they might help explain your transformation to officials! 📸
  3. Be Patient: The process might take time. Think of it as a government-sponsored spa day... with more forms to fill out. 🧘‍♀️

Nature's Plastic Surgery 🌿

Even Mother Nature does some remodeling! Chameleons change their appearance, and some fish can alter their gender. It's like nature's own extreme makeover show! 🦎🐠

Cooking the Books: Can Bean Counters Really End Up Behind Bars? 🧮🚔

Etymology Corner 🔍

The term "cooking the books" dates back to the 1800s, originating from the idea of manipulating financial records as if one were altering a recipe. Talk about a recipe for disaster! 🍳💼

Ah, accounting and auditing – the unsung heroes of the business world! But let's face it, these number-crunching ninjas aren't just battling spreadsheets; they're also dodging potential jail time. So, grab your calculators and let's dive into the risky world of financial wizardry, NgọcPrinny style!! 🧙‍♂️💰

The High-Stakes Game of Balancing Acts

In a nutshell, here's why accountants and auditors might find themselves in hot water:

  1. The Temptation Tango 💃
    • Opportunity + Pressure = Potential for fraud
    • Access to financial records = Power (and great responsibility!)
  2. The "Oops" Factor 😬
    • Honest mistakes can look suspiciously like intentional fraud
    • One misplaced decimal could spell disaster!
  3. The Ethical Tightrope 🎭
    • Caught between pleasing bosses and following the law
    • Sometimes, saying "no" is the hardest part of the job

Case Study: When Numbers Go Rogue 📊🏃‍♂️

Let's look at a real-life example that'll make your abacus beads rattle:

A former chief accountant of a major health institute in Vietnam was recently sentenced to death for embezzling over 152 billion VND (approximately $6.5 million USD). His crime? Using company funds to play the lottery and engage in illegal gambling. Talk about betting it all on red! 🎰

The Accountant's Survival Guide: Stay Out of Jail, Keep Your Job! 📘🔐

  1. Double-Check Everything ✅✅
    • Trust no one, not even yourself!
    • When in doubt, count it out (again)
  2. Keep It Clean 🧼
    • Transparency is your best friend
    • Document, document, document!
  3. Speak Up 📣
    • If something smells fishy, it's probably not your lunch
    • Whistleblowing might save your career (and conscience)
  4. Stay Updated 📚
    • Laws change faster than fashion trends
    • Continuous learning is your get-out-of-jail-free card
  5. Resist Pressure 💪
    • "But everyone's doing it" is not a legal defense
    • Your integrity is worth more than any bonus

The Silver Lining: It's Not All Doom and Gloom! ☀️

Remember, folks, the vast majority of accountants and auditors are honest, hardworking professionals. They're the unsung heroes keeping our financial world spinning! 🌍💼

So, can accountants and auditors end up in jail? Sure, but so can anyone who breaks the law. The key is to stay vigilant, ethical, and maybe invest in a really good pair of reading glasses for those tiny numbers. 🤓

Now go forth and balance those books – legally, of course! 📚⚖️

The Legal Eagles: Unraveling the Mystery of Legal Consultants 🦅⚖️

Etymology Corner 🔍

The term "consultant" comes from the Latin "consultare," meaning "to discuss." When paired with "legal," we get a professional who discusses and advises on matters of law. It's like being a walking, talking law book, but way more fun! 📚🗣️

In a Nutshell

Legal consultants are the unsung heroes of the legal world, bridging the gap between complex laws and everyday people. They're like the translators of legalese, turning confusing jargon into plain English (or whatever language you speak). Let's dive into the world of these law-savvy individualsNgọc Prinny style! 🏊‍♂️📜

Who Can Be a Legal Consultant? 🤔

    • Needs a law degree (no surprise there!)
    • Has at least 3 years of legal work experience
    • Possesses full civil capacity and good moral character
    • Clean criminal record (because advising on law while breaking it is a no-no)
  2. The Lawyer-Turned-Consultant 👨‍⚖️👩‍⚖️
    • A practicing lawyer working for a legal consulting center
    • Follows the rules of both the legal consulting center and the Lawyers Law
  3. The Collaborator 🤝
    • Could be a law graduate or graduate in a related field
    • Might be a current or former legal professional (judge, notary, arbitrator)
    • In special cases, could be someone with practical legal experience in remote areas

The "Can You Do It?" Conundrum 🎭

So, you've just graduated with a law degree and you're eager to start dispensing legal wisdom. Can you become a legal consultant right away? Well, not so fast, young padawan! 🧙‍♂️

  • Fresh Graduates 🎓: Sorry, but you'll need to gain some real-world experience first. Think of it as your legal internship period!
  • Experienced Lawyers 💼: You're good to go! Your years of practice have prepared you for this role.
  • Government Officials 🏛️: If you're working in administrative agencies, courts, or procuracies, you'll need to hang up that government hat before donning the consultant cap.

  2. Diverse Clientele 👥: From individuals to businesses, your advice could shape decisions big and small.

Remember, Aspiring Legal Eagles... 🦅

Becoming a legal consultant isn't just about knowing the law; it's about communicating it effectively and ethically. It's a role that combines knowledge, experience, and a dash of people skills. So, if you're ready to take flight in the legal world, spread those wings and soar! 🌈✨

We all love a good holiday or festival, but what happens when the company conveniently forgets to pay your hard-earned wages? It's like getting a trick instead of a treat! 😱

Labor laws clearly state that employees are entitled to fair compensation for public holidays, yet some companies choose to play Grinch and violate these regulations. It's time to take a stand and defend your rights!

Join the epic quest as we unveil the secret treasures of your employee rights and explore the steps you can take when your employer leaves your wallet feeling empty on those joyful occasions. From deciphering labor laws to summoning the powers of justice, Ngọc Prinny has got your back in this enlightening article.

Get ready to demand the wages you deserve and turn those frowns upside down. Let's make sure every holiday paycheck is a cause for celebration! 🎁💪

In a nutshell:

When your paycheck is as empty as Santa's sleigh after Christmas, it's time to unwrap your rights and demand your holiday dough! Let's dive into the festive world of Vietnamese labor laws and learn how to keep your holidays merry and bright - financially speaking! 🎁💰

Etymology Corner:

"Holiday" comes from the Old English "hāligdæg," meaning "holy day." In Vietnam, it should mean "holy pay day," but some employers seem to have missed the memo! 😉

The Festive Facts: Your Holiday Pay Rights 📅

According to the 2019 Vietnamese Labor Code, you're entitled to full wages on:

🎉 Public Holidays:

  • New Year's Day: January 1 (Gregorian calendar)
  • Lunar New Year (Tet): 5 glorious days of celebration and pay!
  • Victory Day: April 30
  • International Workers' Day: May 1 (ironically, a day off for workers!)
  • National Day: September 2 + 1 adjacent day (double the patriotism, double the pay!)
  • Hung Kings' Commemoration Day: 10th day of the 3rd lunar month

🌍 Bonus for Foreign Workers:

  • Your home country's National Day
  • Your traditional New Year celebration

💼 Annual Leave:

After 12 months of service, you're entitled to:

  • 12 working days for regular jobs
  • 14 working days for tough jobs or vulnerable workers
  • 16 working days for extra tough jobs

Plus, every 5 years with the same employer earns you an extra day off. Talk about loyalty perks! 🎖️

👰🏻‍♀️🤵🏻 Personal Leave:

  • Wedding: 3 days to tie the knot (and recover from the party!)
  • Child's birth: 1 day to welcome your mini-me
  • Death in the family: 3 days to mourn and honor loved ones

When Your Boss Plays Scrooge 😠

If your employer is being a Grinch with your holiday pay, here's your action plan:

1. File a Complaint: 📝

  • Option A: Write a formal complaint to your company's director
    • Be clear, concise, and cite relevant laws
    • Provide evidence (payslips, work schedules, company policies)
  • Option B: File with the local Department of Labor - Invalids and Social Affairs
    • Submit a written complaint detailing the issues and your demands
    • Include supporting documents

2. Mediation: ⚖️

If step 1 fails after 5 working days, take it to court!

  • File a lawsuit at the district or provincial People's Court
  • Location should be where your company is headquartered

3. Know Your Deadlines: ⏰

  • Initial complaint: 180 days from the incident
  • Second complaint: 30 days after the first complaint's resolution period expires

The Price of Being Naughty: Penalties for Non-Payment 💸

Companies face fines for not paying holiday wages:

For unpaid overtime during holidays:

Your Holiday Pay Claim Checklist ✅

  1. Gather Evidence:
    • Payslips showing missing holiday pay
    • Work schedules proving you worked on holidays
    • Company policies regarding holiday compensation
    • Any written communication about holiday pay
  2. Write Your Complaint:
    • Clearly state the issue and the relevant laws
    • Detail the unpaid holidays and amounts owed
    • Request resolution and specify a reasonable timeframe
  3. Submit and Follow Up:
    • Keep copies of all submitted documents
    • Follow up regularly on your claim's progress
    • Be prepared to provide additional information if requested
  4. Know Your Worth:
    • Regular holiday pay should be 100% of your normal wage
    • Overtime on holidays should be at least 300% of your regular wage
    • Don't settle for less than what the law guarantees you!

The Art of Writing a Killer Complaint Letter 🖋️

When crafting your complaint, remember these tips:

  • Be professional: No matter how angry you are, keep it cool and formal
  • Be specific: Mention exact dates, amounts, and incidents
  • Cite the law: Reference relevant sections of the Labor Code
  • State your demands clearly: What do you want the company to do?
  • Set a deadline: Give them a reasonable timeframe to respond

Here's a quick template to get you started:

Dear [Director's Name],

I am writing to formally complain about unpaid holiday wages for [specific holidays].

According to Article 112 of the 2019 Labor Code, I am entitled to full wages for these public holidays. The unpaid amount totals [X] VND, calculated as follows:

[Holiday 1]: [Amount]

[Holiday 2]: [Amount]

I kindly request that this amount be paid in full by [reasonable date].

If this matter is not resolved by then, I will be forced to seek assistance from the Department of Labor - Invalids and Social Affairs.

Thank you for your prompt attention to this matter.

Sincerely,

[Your Name]

In Conclusion

Don't let your holiday cheer turn into holiday fear! Know your rights, stand up for fair pay, and remember: in the world of employment law, it's better to give (your employees their due) than to receive (a hefty fine)! 🎅💼

So, the next time your boss tries to stuff your stocking with coal instead of cash, you'll be ready to jingle all the way to the bank! And remember, claiming your rights doesn't make you a Grinch - it makes you a savvy employee who knows that fair pay is the best gift of all! 🔔💰

The Enchanting Melody of Law Girls: A Poetic Tribute 📚💃

Welcome to my personal blog, where words dance and emotions unfold. Today, I am thrilled to share my original poem that captures the essence of a group often misunderstood and underestimated: the law girls.

Etymology Corner 🔍

The term "law" comes from the Old English "lagu," which is derived from Old Norse "lög" (things laid down or fixed). This root reflects the concept of established rules governing society.

Introduction: Breaking Stereotypes with Rhyme and Reason 🎭✨

Welcome, dear readers, to a world where legal textbooks meet lyrical verses! Today, we're diving into a poetic exploration of those often misunderstood heroines of the courtroom - the law girls. Prepare to have your preconceptions shattered faster than a gavel strikeNgọc Prinny style! 🔨💥

The Vietnamese Original: A Rhythmic Revelation 🎵🇻🇳

First, let's appreciate the original Vietnamese poem in all its glory:

Con gái Luật 👩‍⚖️

Người ta bảo : khô khan - con gái luật 😐

Rất nghiêm trang, hay cãi, ít vui cười 🤨

Chau mặt, cau mày, mặt mũi kém tươi 😠

Chỉ biết "giết người, hiếp dâm, đòi tài sản..." 🕵️‍♀️

Những lĩnh vực nghe tên mà phát nản 😫

Đơn giản vì : ngành học phải vậy thôi!

Chàng trai nào nghe thấy "khiếp quá thôi" 😱

Thì hỡi ôi, sai lầm to lắm đó >:P

Ừ, cũng ghê, nhưng đó là góc nhỏ 🔍

Góc chăm ngoan, học tập ở trường

Còn lúc thường lại rất rất dễ thương 😊

Can đảm, kiên cường, khiêm nhường hết mực =))

The English Rendition: Justice Served with a Side of Sass 🍽️⚖️

Now, let's savor the English translation, reimagined with a dash of wit and a sprinkle of charm:

The Law Ladies' Lament 👩‍⚖️✨

They say we're dry, these girls of law 📜

All frowns and fights, no fun at all

With furrowed brows and pursed lips tight

We only speak of crime and spite

But oh, dear friends, how wrong they are! 🤯

Our world's not just a legal bar

Yes, we study with all our might

But joy and laughter? Pure delight! 😂

We're fierce in court, yet gentle too 🦁🐑

Our minds are sharp, our hearts are true

We don't just bury our heads in books

There's more to us than stern looks 📚👀

We fight for justice, day and night 🌞🌙

With passion, wisdom, and insight

So if you think we're dull or cold

Let me tell you, you've been misled! 🙅‍♀️

For law girls are a special breed 🦄

Of brains and beauty, word and deed

Strong yet soft, smart and kind

A better match you'll never find! 💖

So next time you hear "law girl" said

Don't picture someone stern and dread

Instead, imagine someone grand

The finest creature in the land! 👑

Conclusion: Case Closed on Stereotypes! 🔨

There you have it, folks! A poetic journey through the world of law girls that's sure to overturn any preconceived notions. Remember, behind every stern courtroom face is a multifaceted individual with a heart of gold and a mind of steel. So the next time you meet a law girl, don't judge a book by its cover - you might just be looking at the next legal legend! 🌟👩‍⚖️

Demystifying Traffic Fines in Vietnam: Your Burning Questions Answered

Demystifying Traffic Fines in Vietnam: Your Burning Questions AnsweredNgọc Prinny style

1. What are traffic fines ("Phạt nguội")?

Traffic fines are penalties imposed on individuals who commit traffic violations, which are detected through the use of technical equipment by law enforcement agencies or recorded by devices owned by organizations, individuals, or through information and images posted on public media platforms or social networks, which cannot be immediately addressed by the law enforcement authorities.

In addition, according to Article 24 of Circular No. 65/2020/TT-BCA, the Traffic Police Department is also allowed to impose traffic fines based on images or videos received from the following sources:

- Recorded by technical equipment owned by organizations or individuals (not professional technical equipment).

- Posted on public media platforms or social networks.

In Vietnam, the implementation of traffic fines has been carried out since 2004 and has brought about many positive results in the management of traffic safety, particularly in raising awareness among road users. Despite some limitations, with the increasing coverage of traffic surveillance cameras, traffic fines promise to tighten the legal framework for penalizing traffic violations.

2. Methods of checking fines

2.1. Checking traffic fines on the Traffic Police Department's website

Since June 1, 2019, the Traffic Police Department has launched a software for managing driver's licenses. Here, citizens can check traffic violations by vehicles such as cars, motorcycles, and electric bicycles through images using this software by entering the vehicle's license plate number.

With just a few simple steps, all information regarding the license plate number, time, location, and the unit that detected the violation will be displayed. At the same time, the vehicle owner or the person in charge of the vehicle can contact the address or phone number provided to resolve the violation at the relevant police unit.

To perform the checking, citizens should follow these steps:

Step 1: Access the website of the Traffic Police Department: https://www.csgt.vn/. The "Tra cứu phương tiện vi phạm giao thông qua hình ảnh" section is located on the right side of the screen.

Step 2: Enter the complete license plate number to be checked and select the type of vehicle (car or motorcycle).

Step 3: Enter the security code (combination of letters and numbers next to the blank box).

Sometimes, there may be issues with entering the security code. In such cases, please try again multiple times and enter the correct combination of letters and numbers.

Step 4: Click on "Tra cứu" to retrieve the results.

The system will then provide the results of the traffic violation captured by the camera. If no results are found, it means the vehicle has not incurred any traffic fines.

(images below)

2.2. Checking car fines on the website of the Vietnam Register

Step 1: Visit the website of the Vietnam Register at www.vr.org.vn and go to the "Phương tiện xe cơ giới cho chủ phương tiện" section under the "Tra cứu dữ liệu" on the right side of the screen.

Step 2: Enter all the necessary information for the search.

For vehicles with 5-digit license plates: Add the letter "T" for white plates, the letter "X" for blue plates, and the letter "V" for yellow plates.

Similarly, for sticker numbers and current certificates, enter a dash "-" to separate the letters and numbers.

Step 3: Scroll down, and the screen will display notifications from relevant authorities regarding the vehicle at the bottom.

If the vehicle has incurred fines, all the information will be listed in the results section.

If this section is empty, it means the vehicle has not been fined, and the registration process can proceed as normal.

If there is a black box with violation processing information inside it, it indicates that the vehicle has not settled the fines and will be denied registration.

2.3. Direct checking on the website of the Department of Transport

This method of checking fines is only applicable to provinces and cities that have integrated fine checking on the traffic fine website.

Step 1: Access the local traffic fine website:

- Checking fines in Hanoi:

https://csgt.congan.hanoi.gov.vn/tra-cuu-phuong-tien-gt

- Checking fines in Ho Chi Minh City:

http://csgt.catphcm.bocongan.gov.vn/wps/portal/Home/tra-cuu-vi-pham

- Checking fines in Da Nang:

https://vpgtcatp.danang.gov.vn/

Step 2: Enter all the necessary vehicle information to perform the search.

3. What should be noted when checking traffic fines?

By following the provided instructions, individuals can easily check traffic fines. However, during the checking process, the following points should be noted:

- When entering the license plate number, ensure to enter it correctly according to the instructions. For example, the license plate must be written without spaces and with the appropriate hyphens.

- Both the license plate number and sticker number/certificate of inspection must be entered.

- If the vehicle owner is not the one directly operating the vehicle at the time of the violation (e.g., borrowing or renting a vehicle), but fails to provide an explanation or evidence, they will be fined according to the violation.

4. How long after a violation can fines be checked?

The specific time for checking fines after a violation has not been determined yet, as it depends on when the traffic violation was detected and reported.

According to Article 4, Clause 2 of Circular 15/2022/TT-BCA, when a traffic violation is detected through the fine system, the traffic police at the location of the violation will verify the information about the person and the violating vehicle.

Then, a fine notice will be sent to the vehicle owner who committed the violation, inviting them to the police station to resolve the violation. The deadline for sending the fine notice is 10 days from the date of detecting the violation.

If the violator does not come to the police station to resolve the violation within 20 days from the date of sending the fine notice, the traffic police will update the information of the violating vehicle on the Electronic Information Portal of the Traffic Police Department.

According to this regulation, if a violation is detected immediately when it occurs, organizations or individuals can check the fines after about 30 days from the violation date.

However, if the violation is not detected immediately, it is difficult to determine the exact duration for checking the fines.

5. How to pay traffic fines?

Before paying the traffic fines, the violator needs to go to the police station where the violation occurred or their place of residence (if not residing within the district where the violation occurred) to resolve the traffic violation and receive the penalty decision.

After receiving the traffic penalty decision, organizations or individuals can pay the fines through one of the methods specified in Article 20 of Decree 118/2021/NĐ-CP, as follows:

- Pay in cash directly at the State Treasury or at a bank where the State Treasury has opened an account specified in the penalty decision.

- Transfer the fine amount to the account of the State Treasury specified in the penalty decision.

- Pay through the National Public Service Portal or electronic payment services of banks or intermediary payment service providers.

- Pay the fine directly to the traffic police for violations with a fine amount of up to 250,000 VND for individuals and 500,000 VND for organizations.

- Pay the fine via postal services.

7. Answering some questions about traffic fines

7.1. Do traffic police make phone calls to notify about fines?

In addition to inquiries about checking fines, many people also wonder if the Traffic Police make phone calls to notify about fines.

According to Article 19a of Circular 65/2020/TT-BCA, amended by Circular 15/2022/TT-BCA, the notification of fines is carried out through written documents using form 02/65/68. This document will be sent to the vehicle owner, organization, or individual related to the administrative violation.

The notification of fines can be sent by the Traffic Police unit at the location where the violation was detected through postal services or local officers.

Regarding phone calls to notify about fines, the representative of the Traffic Police Department stated that the Traffic Police units do not make phone calls to inform about violations of traffic safety regulations, nor do they require the violators to transfer fine payments to any account.

Therefore, cases where phone calls are made to notify about fines are mostly scams. Citizens need to be vigilant and not provide or share personal information, identification documents, phone numbers, bank account information, or transfer fine payments to anyone.

7.2. What happens if the fine is not paid?

Although a large number of fine notifications are sent out, the compliance rate of paying fines is still not high. So what happens if the fine is not paid?

According to Article 73, Section 1 of the Law on Handling of Administrative Violations 2012, individuals and organizations subject to administrative fines must comply with the fine decision within a period of 10 days from the date of receiving the decision. If the deadline for enforcement is longer than 10 days, it will be implemented according to that deadline.

If the fine is not paid within the prescribed time limit, according to Article 78, Section 1 of the Law on Handling of Administrative Violations, the individual or organization that violates the law will be enforced to pay the fine decision. For each day of delay in paying the fine, an additional 0.05% of the total outstanding fine amount must be paid.

In the case of automobiles involved in fine violations, if the fine is not paid on time, the vehicle will be refused registration for inspection due to being included in the warning list of vehicles related to administrative violations in the Inspection Management Program.

7.3. How long does it take for a fine to be cleared?

According to Article 19a of Circular 65/2020/TT-BCA, amended by Circular 15/2022/TT-BCA, after the traffic violation case is resolved, the police authority will update the status of the resolved and processed case on the Electronic Information Portal of the Traffic Police Department and immediately send a notification of the end of the warning about the violated vehicle to the inspection authority, removing the status of the warning notification sent to the inspection authority in the Inspection Management Program.

Accordingly, individuals and organizations will have their fines cleared immediately after paying the fines as required.
